Billie Addleman Obtains Dismissal of Medmal Suit
In July 2009, Billie LM Addleman successfully obtained dismissal of a medical malpractice action filed against a large northern Wyoming regional hospital.
Defendant filed a motion to dismiss the Complaint arguing that Plaintiff failed to file a claim with the Medical Review Panel, a condition precedent to filing suit in court. Plaintiff objected to the motion to dismiss arguing that she brought a claim for negligence not medical malpractice. The District Court agreed with the Defendant finding that Plaintiff’s claim was a medical malpractice claim and that her failure to file a claim with the Medical Review Panel barred the lawsuit. Plaintiff has indicated that she will appeal the dismissal to the Wyoming Supreme Court.
